How we collect personal information
directly from you, such as when you enter your personal details on our websites (eg during registration or application for products and services), when you provide information by phone or in documents such as an application form;
from third parties such as our related companies, credit reporting agencies or your representatives;

from our own records of how you use Chard™ services

How we use your information

Your personal information may be used to:
identify you and to assist you to subscribe to our website goods or services more easily;
provide the goods or services you require;
administer and manage those services, including charging, billing and collecting debts;
gain an understanding of your information needs in order for us to provide you with better goods or services that are tailored to your needs;
inform you of ways the services provided to you could be improved;

Your personal information is also collected to promote and market to you other goods and services which we consider may be of interest to you. That is, we will send you such material only if you elect to receive it or if it is provided to you in response to your request.

The marketing information provided on our websites will be determined by where you decide to visit on the site. Advertisements will also be presented to you, but the placement of these is not related specifically to any details we hold about you.

Personal information collected from our websites

The types of personal information we collect from you will depend on how you use our web sites. Such information may include your name, current and previous addresses, telephone/mobile phone number, email address, occupation or type of business, and your Chard™ username or password. We may also collect details of your Chard™ services (including their status) and your personal interests.

If you choose not to provide personal information, we may not be able to provide you with the services you require, or the level of service on which we pride ourselves.

Other information

Our websites record other information as well. This information is used to improve the structure and performance of this site to provide users with an improved goods and service. Whenever a page is requested from our web server, we record the time, date and URL of the request, along with information on the browser software that is being used.

When we disclose your personal information

For the purposes set out above (under "How we use your personal information") we may disclose your personal information to organisations outside Chard™. Where appropriate, these disclosures are subject to privacy and confidentiality protections. The organisations to which we usually disclose information include:

  installation, maintenance and repair services;
  marketing;

our professional advisers, including our accountants, auditors and lawyers;

  managing our corporate risk and funding functions (eg securitisation);
other telecommunication and information service providers; and

Help us to ensure we hold accurate information

Chard™ takes all reasonable precautions to ensure that the personal information we collect, use and disclose is accurate, complete and up-to-date. However, the accuracy of the information we hold depends to a large extent on the information you provide.

That's why we recommend you:
let us know if there are any errors in your personal information; and
keep us up to date with changes to your personal information such as your name or address.

You can easily edit or delete the personal information you provide to us on our websites (unless it is mandatory information required for billing, debt recovery or by law), but to do so, you will need to log in as a registered user, using your username and password.

If you wish to access or modify personal information which you have provided via our websites, but cannot access that information at ourwebsites, please send an email using the Contact Us page .

You can access your personal information

You have a right to access your personal information, subject to some exceptions allowed by law. If you would like to do so, please let us know by sending an email using the Contact Us page. You may be required to put your request in writing for security reasons. Chard™ reserves the right to charge a fee for searching for and providing access to your information.

Security of your information

We take reasonable steps to ensure that your personal information is stored securely. Transmissions sent to or from our websites are routinely monitored for quality control and systems administration. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. While we strive to protect your personal information from misuse, loss and unauthorised access, we cannot guarantee the security of any information you transmit to us or receive from our online products or services. These activities are conducted at your own risk. Once we receive your transmission, we make our best effort to ensure its security.

Children's Privacy

Children's privacy is very important to us. The products and services provided by Chard™ are intended for uses 16 and older. Accordingly, we will not knowingly collect or use any personal information from children under the age of 16. In addition, we will delete any information in our database that we know originates from a child under the age of 16. We ask that children under the age of 18 have a parent or guardian verify their purchases from Chard™. While Chard™ will make every reasonable effort to ensure that children's privacy and other rights are not compromised, it is ultimately the responsibility of parents to monitor their children's Internet usage.

What else you should know about privacy

Remember to close your browser when you have finished your user session. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe. You as an individual are responsible for the security of and access to your own computer.

Please be aware that whenever you voluntarily disclose personal information over the Internet (for example: in discussion forums, via email, or in chat sites) that this information can be collected and used by others. In short, if you post personal information in publicly accessible online forums, you may receive unsolicited messages from other parties in return.

Ultimately, you are solely responsible for maintaining the secrecy of your username and passwords and any account information. Please be careful and responsible whenever you are using the Internet and our websites.

Online by Credit Card

Simply browse or search Chard™ site to find the products you are interested in. Add them to your shopping cart by clicking the "Add to Shopping Cart" button (don't worry, you can always remove them later if you change your mind). When you add an item to your shopping cart you will be taken to the shopping page, which shows you what is in your shopping cart. From this page, you may continue shopping, or proceed with your purchase by clicking on the "Checkout" button.

Once you are ready to make a purchase, click on the "Checkout" button on the shopping page. We'll need to know your name and address (see above) and you should enter an easy-to-remember password of your choice so you can save time when you shop with us in the future. Once you have filled in all your details, click the "Submit" button.

The final screen in the checkout process is the credit card page. Select the "Credit Card" button. An Email will be sent to you for you to fill in and FAX BACK - (DO NOT EMAIL YOUR CREDIT CARD DETAILS TO US UNDER ANY CIRCUMSTANCES.)

Direct Deposit

Simply browse or search Chard™ site to find the products you are interested in. Add them to your shopping cart by clicking the "Add to Shopping Cart" button (don't worry, you can always remove them later if you change your mind). When you add an item to your shopping cart you will be taken to the shopping page, which shows you what is in your shopping cart. From this page, you may continue shopping, or proceed with your purchase by clicking on the "Checkout" button.

Once you are ready to make a purchase, click on the "Checkout" button on the shopping page. We'll need to know your name and address (see above) and you should enter an easy-to-remember password of your choice so you can save time when you shop with us in the future. Once you have filled in all your details, click the "Direct Deposit" button. An email will be sent to you with Banking Details for you to be able to pay for your order.

Post Order with Cheque, Money Order details:

It is possible to place an order by post and enclose a cheque or money order for payment. If you do adopt this ordering method, please print off your email order and post it with your cheque, money order to address provided in email.

Please also ensure that you include your daytime phone number and email address so that a staff member may contact you if an item has become unavailable.

Terms & Conditions

Chard™ and its affiliates provide their goods and services to you on the following terms and conditions. By placing an order you agree to be bound by those terms and conditions and all of the policies incorporated by reference ("Policies").

These terms and conditions together with the Policies constitute the entire agreement between Chard™ and the user and supersede and cancel all prior agreements, claims, representations and understandings.
You are an adult at least 18 years of age and can lawfully enter into and form contracts under Australian law.
You have familiarised yourself with our Returns Policy and Shipping Information.
You are familiar with the customs policies of your country and agree that you will be responsible for compliance with all local laws which may restrict the importation of certain goods and that you alone will be responsible for payment of any present or future tax or import duty or charges which may be imposed or assessed by any relevant regulatory authority on the goods purchased on the site.
All prices quoted on the site are inclusive of Australian Goods and Services Tax.
You understand that, to the fullest extent permitted by law, Chard™ makes no warranties of any kind whatsoever whether express or implied, and specifically no warranty of merchantability or fitness for a particular purpose and in no event shall Chard™ be liable, whether in contract or tort for any damages to the user in respect of economic loss, any loss or damage to property or death or injury to any person of whatever nature and however or wherever sustained that arises out of or is in any way connected with the purchase or delivery of any product.
Where any condition or warranty cannot be excluded under applicable legislation Chard™ liability for breach of condition or warranty shall be limited to either:
 
replacing the product; or
crediting the cost of the product to the user.
In no event shall Chard™ be liable for exemplary, special or consequential damages or losses or loss of profits.
You agree that the laws of Victoria Australia will govern this site and the sale and purchase of any goods from this site. By using this site you agree that any action at law or in equity arising out of or relating to this site or the sale and purchase of any goods from this site will be filed only in Victoria or federal courts located in Victoria Australia and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts.
The site or any portion of the site may not be reproduced, duplicated, copied, sold, resold or otherwise exploited for any commercial purpose that is not expressly permitted by Chard™. Chard™ and its affiliates reserve the right to refuse service, terminate accounts or cancel orders in its discretion, including, without limitation if Chard™ believes that customer conduct violates applicable law or is harmful to the interests of Chard™ and its affiliates.
The site may only be used for lawful purposes and in a lawful manner. When ordering from Chard™ you are the purchaser of the goods and must comply with all applicable laws and regulations. It is your responsibility to investigate and ensure that you can lawfully purchase the goods you order.
